Court suspends Keystone XL pipeline construction

Montana Court suspended the construction of the controversial pipeline that would take oil between Canada and the United States. This determination is considered a triumph for the environmental organizations and the native populations of North America. The pipeline had restarted its construction work after a unilateral order of Donald Trump.

Servindi, November 14th, 2018.- A new milestone was written in the complicated history of the Keystone XL pipeline that for years the United States government has been trying to build to transport crude to and from Canada. This time a Montana state court decided to suspend the construction of the project that had been imposed unilaterally by Donald Trump’s administration.

For a while, this TransCanada project has kept environmental groups and Native federations of North America confronted with the Federal Government of the United States. This due to the pipeline, during its trajectory, would put in risk ancestral territories and sources of water for the original populations of the North American hemisphere.

 "The court orders Federal Defendants and TransCanada not to participate in any activity to promote the construction or operation of Keystone and associated facilities until the Department has completed a supplement to the SEIS 2014 (Supplemental Environmental Impact Statement) that meets the requirements ", points out the ruling of the court.

Judge Brian Morris's argument would be that the United States Government, under the administration of Donald Trump, used a 2014 environmental exam to justify the presidential permit for the resumption of construction of the pipeline. However, this permit would violate the National Environmental Policy Act (NEPA) and the Endangered Species Act.

A long history of a pipeline

This event is just one more point in the controversial history of the Keystone XL pipeline that is being built from Alberta (Canada) to Nebraska (United States) with the objective of mobilizing Canadian oil. This pipeline would also be part of a larger project that involves the connection with the oil extracted from the Gulf of Mexico.

Although the government of Barack Obama had stopped the construction of the pipeline in 2016 amid big conflicts with the indigenous peoples, in March of the 2017 President Donald Trump authoritatively authorized the viability of the project. It is this decision that generated the most controversy and that, for now, has been revoked by a Montana court.

For the moment, the future of the pipeline remains uncertain. The Government of the United States and the company TransCanada have a limited period of time to repair the errors indicated by the court. Will the controversial Keystone XL that has generated so much trouble with the original North American peoples finally be built?
